Preamble The company AtmosNode E.I, registered under number 899 139 182 with the Douai Trade and Companies Register. Its head office is located at 26 rue Louis Aragon, 59286 ROOST-WARENDIN. AtmosNode E.I (hereinafter the "Provider"), is a company specialized in hosting services for professionals and individuals. If a client wishes to use the services of AtmosNode E.I, they must accept these general terms and conditions of hosting (GTC), which apply to business relationships between the client and AtmosNode E.I. If the client is a professional, they waive their own general terms of purchase. AtmosNode E.I asserts that it has the necessary skills and expertise to provide hosting services, and the parties agree to execute this agreement in an honest and fair manner. The client also agrees to comply with these GTC. In case of incapacity, the clauses applied to the client are also applied to their legal representatives (Parents or legal guardians). AtmosNode E.I may operate under several trade names. In this case, these terms apply in the same way as if the sale had been concluded under the name AtmosNode.
Article 1: PurposeThese general terms and conditions of sale detail the rights and obligations of AtmosNode and its Client in the context of the sale, rental, or provision of services.

The use of our services implies acceptance of these General Terms of Use (GTU). AtmosNode reserves the right to modify these terms without prior notice to its clients. It is therefore the Client's responsibility to stay informed of any changes made to this document. To facilitate access, AtmosNode provides a link to this document at the bottom of its website's homepage.
Article 2: PricingUnless otherwise stated, prices are expressed in euros (EUR, euro, €) and include all taxes (TTC). The prices of products and services sold are those in effect on the date of the order. If the price of a product or service changes after the order, the invoiced amount will remain unchanged, except in case of changes to taxes included in the TTC price or additional fees related to the use of a payment method. However, AtmosNode reserves the right to apply a price increase or decrease on already subscribed services on a one-time basis, with 1 month(s) notice. It is understood that in case of modification of a service's characteristics, its price may also be adjusted.

AtmosNode reserves the right to modify prices at any time. Ordered services are considered active as soon as AtmosNode begins the setup process. All our services can be canceled and refunded at any time in accordance with the refund policy, with the exception of personalized, custom, or off-catalog services. The account balance is non-refundable, but a payment made to provision this balance can be refunded within 24 hours following the transaction. The Client is free to renew or not renew their service, as all our services are without commitment.
Article 3: Compliance with legal obligationsAny abusive or illegal use of the service in relation to French legislation will result in permanent deletion without refund of the service as well as a complaint to the competent authorities. The Client is prohibited from carrying out any hacking or intrusion activity from a service provided by AtmosNode. It is the Client's responsibility to hold the necessary licenses for the software and operating systems they use.

As an example, here is a non-exhaustive list of illegal activities:
- Denial of service attacks
- Port scanning
- Sending spam or phishing emails
- Hosting child pornography content
- Hosting content violating copyright
- Publishing personal data (Doxing)
- Publishing stolen data (database leaks)
- Publishing anti-Semitic, racist, xenophobic, homophobic content, inciting hatred, or promoting terrorism

In case of judicial requisition, AtmosNode agrees to cooperate with public authorities. If AtmosNode is subject to legal proceedings due to illegal use of a service provided to the Client, the Client will be required to compensate AtmosNode for all costs incurred for its defense as well as for ancillary costs related to this procedure.
Article 4: LimitationsAtmosNode provides services that may be shared among multiple users. Therefore, each Client must make reasonable use of them, i.e., avoid any overconsumption that could harm other users, as well as the hardware or network infrastructure. Consequently, even while complying with regulations, AtmosNode prohibits its clients from using its service for:
- Offering mass anonymization services (VPN, Proxy), unless the use is exclusive to the Client
- Hosting seedboxes
- Using P2P file-sharing devices, such as Torrent or Emule
- Cryptocurrency mining (including using storage)
Article 5: LiabilityJustification of use of the service provided by AtmosNode contrary to the GTU, even for testing or on infrastructure belonging to the Client, is not acceptable. Regardless of the service provided by AtmosNode, the Client remains fully responsible for it and must assume all consequences, including in case of service compromise. In case of service sharing, only the account holder is responsible for its use. If a Client uses a service in violation of the General Terms of Use (GTU), AtmosNode reserves the right to suspend or delete the service without refund. In case of damage to AtmosNode following use contrary to the GTU, the company may request damages. The Client is responsible for the service made available to them, including if they suffer economic, material, or physical damage related to this service.
Article 6: Quality of serviceAtmosNode provides quality service to its clients. However, technical problems may occur beyond our control. In case of a problem, whether attributable to AtmosNode or the Client, the Client cannot demand compensation. However, AtmosNode remains accommodating and may, in case of a problem within its responsibility, grant a goodwill gesture.

AtmosNode is committed to deploying all necessary means to avoid problems that may affect its clients. In case of difficulty, customer service is available, although AtmosNode cannot guarantee a specific response time. The company nevertheless commits to providing a quick response within reasonable timeframes. Support is limited to problems specifically related to the services provided, and AtmosNode does not provide support for server use or installation. It is therefore the Client's responsibility, when purchasing, to be able to configure and use the service independently. In exchanges with customer service, any Client behavior that hinders the proper completion of support may result in blocking access to customer service, or even account suspension if such behavior is repeated. As examples, the following are considered unacceptable behaviors: insults, defamation, racist, homophobic remarks, etc.
Article 7: ConfidentialityAtmosNode commits not to access its clients' server hard drives, except in case of maintenance or technical necessity. AtmosNode and the Client commit to respecting the confidentiality of private messages and the secrecy of correspondence. In accordance with the law of January 6, 1978 (article 27), known as "Data Protection," you have a right of access and correction regarding your personal data. AtmosNode commits to respecting its clients' privacy and confidentiality, and provides a "Privacy Policy" page, accessible from the bottom of the homepage, to summarize the data collected as well as the reasons for this collection. AtmosNode's confidentiality commitment does not apply in the case where a judicial authority requires the communication of a client's data.
